This prohibition is established in accordance with the applicable European and international legal framework on intellectual property, particularly with respect to the rights holder's exclusive rights over reproduction, distribution, public communication, and adaptation of the work, as well as the provisions governing the protection of works in the digital environment.
Pursuant to Article 9 of the Berne Convention, authors have the exclusive right to authorize the reproduction of their works in any manner or form; in addition, Article 2 of Directive 2001/29/EC recognizes the exclusive right to authorize or prohibit direct or indirect, temporary or permanent reproduction, in whole or in part, by any means. The WIPO Copyright Treaty also confirms that this right fully applies in the digital environment.
